Welcome to RenderCAD! These Terms of Service ("Terms") govern your use of the RenderCAD service at rendercad.ai, our desktop applications, and browser extensions (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use RenderCAD. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

3.1 Account Creation

• You may register using Google OAuth or email/password authentication
• You must provide accurate and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities under your account

3.2 Account Security

• Enable two-factor authentication (2FA) for enhanced security
• Notify us immediately of any unauthorized access
• We are not liable for losses due to stolen credentials or unauthorized access

4. Service Description

RenderCAD is an AI-powered CAD rendering service that transforms your designs into photorealistic renders. The Service includes:

• Web interface at rendercad.ai
• Desktop applications for Windows/Mac/Linux
• Browser extensions for Chrome/Edge/Firefox
• API access for programmatic rendering

5. Subscription Plans

5.1 Available Plans

Current subscription plans, pricing, and render limits are available at rendercad.ai/pricing.

5.2 Billing

• Subscriptions are billed monthly via Stripe
• Billing occurs monthly on the anniversary of your subscription signup date
• Render limits reset on your subscription renewal date (anniversary of signup)
• Unused renders do not roll over to the next billing period

5.3 Cancellation and Refunds

• You may cancel your subscription at any time via Settings or Stripe portal
• Cancellation takes effect at the end of the current billing period
• No refunds for partial months or unused renders
• Beta plan users may have access revoked at any time

5.4 Plan Changes

• Upgrades: Take effect immediately with prorated billing for the remainder of your billing period
• Upgrade Render Limits: When upgrading, the difference between your new plan's limit and old plan's limit is added to your remaining renders
• Downgrades: Take effect at the end of your current billing period. You retain access to your current plan until then
• Plan changes are processed through Stripe and may take a few minutes to reflect in your account

6. Acceptable Use

6.1 Permitted Use

You may use RenderCAD for:

• Rendering your own CAD designs and models
• Commercial projects (architecture, product design, etc.)
• Personal and educational purposes
• Content you have rights or permission to render

6.2 Prohibited Use

You may NOT:

• Upload illegal, harmful, or offensive content
• Violate intellectual property rights of others
• Attempt to reverse-engineer or bypass Service limitations
• Share or resell your account access
• Use the Service for cryptocurrency mining or other resource abuse
• Scrape, crawl, or automatically download Service content
• Upload malware, viruses, or malicious code
• Harass, spam, or abuse our support channels

7. Content and Intellectual Property

7.1 Your Content

• You retain all rights to content you upload ("Input Content")
• You grant us a limited license to process your Input Content for rendering
• You are solely responsible for your Input Content
• You represent that you have all necessary rights to upload and render your content

7.2 Rendered Output

• You own the rendered outputs generated from your Input Content
• We do not claim ownership of your renders
• You may use rendered outputs for any lawful purpose

7.3 Rendering Quality and Disclaimer

• Best Effort Service: RenderCAD strives to produce high-quality renders, but AI-generated results may vary. Occasional suboptimal outputs are not grounds for refunds
• Input Quality Determines Output: The quality of your rendered output is largely determined by the size, resolution, and detail of your input image. Higher quality, more detailed inputs generally produce better results
• User Responsibility: You are entirely responsible for the rendered outputs and how they are used. You accept that AI rendering is inherently variable
• No Guarantee of Specific Results: We do not guarantee that renders will match your exact expectations. AI models may produce unexpected, unusual, or imperfect results
• Limitation of Liability for Outputs: RenderCAD is not responsible for any unexpected, unusual, or undesirable elements in rendered outputs. While we continuously work to improve our service, the nature of AI rendering means results cannot be guaranteed

7.4 RenderCAD Intellectual Property

• The Service, including software, algorithms, and branding, is owned by RenderCAD, LLC
• You may not copy, modify, or distribute our Service or technology
• RenderCAD™ and associated logos are trademarks of RenderCAD, LLC

8. Data Storage and Retention

• Input images and rendered outputs are stored on secure cloud storage infrastructure
• Retention periods based on subscription tier (30-365 days)
• Files may be automatically deleted after retention period expires
• We recommend downloading important renders for local backup
• Deleted accounts have all data permanently removed within 30 days

9. API Access

• API tokens are subject to the same rate limits as web interface
• Desktop apps and browser extensions require separate authentication
• You must keep API tokens confidential
• Revoke compromised tokens immediately via Settings
• API abuse may result in account suspension

10. Service Availability

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• Scheduled maintenance will be announced in advance when possible
• We are not liable for service interruptions or data loss
• Beta features may be unstable or discontinued without notice

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• RenderCAD is provided "AS IS" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the past 12 months
• We are not responsible for third-party services (Stripe, Google, Cloudflare)

12. Indemnification

You agree to indemnify and hold harmless RenderCAD, LLC from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your Input Content or use of rendered outputs
• Your infringement of third-party rights

13. Account Termination

13.1 Your Right to Terminate

• You may delete your account at any time via Settings page
• Deletion is permanent and cannot be undone
• All data will be removed within 30 days

13.2 Our Right to Terminate

We may suspend or terminate your account if you:

• Violate these Terms or our policies
• Abuse the Service or engage in prohibited use
• Fail to pay subscription fees
• Engage in fraudulent activity

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or prominent notice on the Service. Continued use after changes constitutes acceptance of the modified Terms.

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

15.2 Arbitration

Any disputes will be resolved through binding arbitration in accordance with the American Arbitration Association rules, except for claims of intellectual property infringement.

16. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and RenderCAD
• Severability: If any provision is found invalid, the remaining provisions remain in effect
• No Waiver: Our failure to enforce any right does not waive that right
• Assignment: You may not assign these Terms; we may assign them to a successor
